    Even as the FDA bans the herb, other potentially dangerous supplements are taking its place Healthy, Wealthy, But Wise?

    It’s only been a few weeks since the Food and Drug Administration announced the ban on products containing the herb ephedra, but the health food industry has hardly skipped a beat. As a substitute for ephedra in its weight loss and energy boosting supplements, it has begun using such stimulants as green tea extract and bitter orange. Consumer Reports recently said that green tea extract, especially combined with caffeine and other stimulants, can cause a host of minor and possibly major ills. Even worse, bitter orange can have effects similar to those caused by ephedra, which elevates blood pressure, stresses the nervous system, and has been responsible for a hundred-odd deaths and thousands of strokes and heart attacks.

After careful study and tens of thousands of adverse reports, and numerous deaths associated with ephedra, they have closed the lid on a deadly diet product.     FDA Bans all ephedra products

    On Dec. 30, 2003, FDA issued a consumer alert on the safety of dietary supplements containing ephedra. The alert advised consumers to immediately stop buying and using ephedra products. Ephedra, also called Ma huang, is a naturally occurring substance derived from plants. Its principal active ingredient is ephedrine, which when chemically synthesized is regulated as a drug. In recent years ephedra products have been extensively promoted to aid weight loss, enhance sports performance, and increase energy.

    FTC takes action against many ephedra vendors

    July 1, 2003 - FTC Charges Direct Marketers of Ephedra Weight Loss Products With Making Deceptive Efficacy and Safety Claims
    FTC Also Challenges Advertising Claims for Additional Dietary Supplements, including Bentley-Myers of Vancouver, Canada.
    The Federal Trade Commission today announced three enforcement actions against direct marketers of weight-loss products containing ephedra. The two settlements and one complaint, filed in U.S. district court, target deceptive efficacy, safety, and “no side effects” claims for weight loss supplements containing ephedra (also known as Ma Huang). The FTC actions challenge false advertising claims that the ephedra supplements cause rapid, substantial, and permanent weight-loss without diet or exercise, and that “clinical studies” or “medical research” prove these claims. The FTC also challenges claims that the ephedra weight-loss products are “100% safe,” “perfectly safe,” or have “no side effects.” The counties accuse Manasquan, N.J.-based Cytodyne Technologies of false and misleading advertising that does not mention possible health risks associated with the product.

NY Times - June 23, 2003 - When a California judge handed down a $12.5 million false-advertising judgment against the maker of an ephedra-based weight-loss pill late last month, he also issued what amounted to a bill of reproach against the science of dietary supplements. Muscletech was unhappy with another study, by the University of Guelph in Ontario, that found Hydroxycut did not "burn fat," a claim made by many companies that sell ephedra. The company was unable to keep Guelph from publishing the results, but demanded that its product name be removed from publications.
    California counties sue ephedra maker

    Eight California counties and one city have filed suit against the maker of a dietary supplement that contains ephedra, alleging deceptive advertising. The counties accuse Manasquan, N.J.-based Cytodyne Technologies of false and misleading advertising that does not mention possible health risks associated with the product.


    U.S. government takes aim against Ephedra


    The Department of Health and Human Services (HHS) today announced a series of actions designed to protect Americans from potentially serious risks of dietary supplement products containing ephedra. Many of today's proposed actions involve a Federal Register notice, which went on display today, reopening for 30 days the comment period on a draft regulation FDA first proposed in 1997 and modified in 2000.

The press reported that he was taking Xenadrine. The local coroner said that it was partially to blame and that no athlete should be taking it. Now if only the rest of the world would follow suit.

    Suffolk County, New York Bans Ephedra
    SMITHTOWN, N.Y.--Suffolk County in New York state became the first region to completely ban ephedra sales. On Feb. 11, the county passed an initiative by a vote of 12 to 5 (with one abstention) to ban the sale of ephedra products. The impetus for this bill was a Suffolk County 20-year-old's death, allegedly from ephedra consumption. And since the initiative passed, Cooper has received a call from another Suffolk County resident whose wife had died, also allegedly from ephedra.

    Government delays actions
    In a victory for the food supplement industry, the US government said on Friday it would delay limiting the use of the popular weight-loss supplement ephedra until more studies on its safety were in. In January Health Canada, Canada's equivalent of the FDA, expressed worry about excessive doses of ephedra, also known as ephedrine, and asked makers to voluntarily recall products containing high doses of the supplement.

    The Food and Drug Administration and the National Council Against Health Fraud have identifiedephedrine as the worst over-the-counter and/or mail order product. It is contained in many diet pills and food supplements. The FDA has reported in excess of 300 cases of adverse reaction to ephedrine in 1994 and 1995 alone. Dozens of deaths have been linked to the pills.
